Terms of use
SIA Matrixsoftlabs, REGISTRATION NO.: 41203066773, ADDRESS: Talsu novads, Valdemārpils, Krišjāņa Valdemāra iela 19A, LV-3260, hereinafter referred to as the online store, provides content available on the website and provides goods/services in accordance with the Terms of Use set out below.
1. General Provisions
If a consumer purchases goods/services through the website, such mutual agreement is considered a Distance contract and is subject to the norms of the laws of the Republic of Latvia that regulate distance contracts, including, but not limited to, the Consumer Rights Protection Law of the Republic of Latvia, the Cabinet of Ministers Regulations "Regulations on Distance Contracts", etc.
2. Making a Purchase
The prices and specifications of products sold in the online store are indicated next to the products.
To place an order, add the desired products to the shopping cart. Fill in all required fields and choose the most suitable delivery method. The total cost of the order with delivery is then displayed on the screen. Complete the purchase payment to finish the order.
3. Payment Terms
The currency for transactions on the site is Euro. Purchases can be paid for by selecting the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:
Payments from Latvian internet banks: Swedbank, SEB, Citadele, and Luminor
Payments from Estonian internet banks: Swedbank, SEB, Luminor
Payments from Lithuanian internet banks: Swedbank, SEB, and Luminor
Visa/Mastercard card payments
NB! When using an internet bank payment method, confirm the order and click on the "Return to merchant" button.
Personal data necessary for making the payment is transferred to the licensed payment institution Maksekeskus AS.
The contract comes into effect upon successful payment to the online store's bank account. If for some reason it is not possible to fulfill the order, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than 14 days after notification.
4. Delivery Terms
Goods are delivered to the following countries: Estonia, Latvija, Lithuania. The purchased goods are delivered using: SIA DPD Latvija, SIA Omniva. All fees and taxes that must be paid to receive the shipment at the delivery destination must be covered by the Buyer. Delivery costs are shown before order confirmation. The purchased goods are delivered to the Buyer's specified address within 2-4 working days. In exceptional cases, we have the right to send goods up to 45 calendar days, informing the customer about it.
5. Right of Withdrawal
The Buyer has the right to withdraw from the product within 14 calendar days from the moment of receiving the Goods. (Depending on the product, the buyer may not have a mandatory right of withdrawal, in which case the reason must be clearly stated and explained). The right of withdrawal does not apply if the Buyer is a legal entity.
To use the 14-day right of withdrawal, the goods may only be used for their intended purposes, and the consumer is responsible for maintaining the quality and safety of the product during the withdrawal period. If the goods are misused or damaged, carelessly treated, or instructions not followed, if the original packaging of the goods is lost, or if its packaging is significantly damaged, the online store has the right to reduce the refundable amount according to the decrease in the value of the goods.
To use the right of withdrawal, you must submit a withdrawal form, which can be found here: Return Form, sending it to the email address davis@matrixsoftlabs.com within 14 days of receiving the goods.
The following sentence is intended for online stores that cannot offer a free return option. The Buyer covers the cost of returning the goods, except in cases where the reason for the return is that the product does not match the order (e.g., incorrect or damaged product).
The Buyer's obligation is to return the Goods to the Seller without delay, but no later than 14 days after sending the withdrawal form to the online store. After receiving the returned goods, the online store will immediately, but no later than within 14 days, refund all payments received from the buyer based on the Distance contract.
The Seller has the right to withhold payment until the Goods are received from the Buyer or until the Buyer provides proof of returning the goods. If the buyer has chosen a method of shipment other than the cheapest standard delivery
offered by the online store, the online store is not obliged to reimburse the exceeded shipping costs.
The online store is not responsible for delays in fulfilling obligations or failure to fulfill them, or any other non-performance arising from circumstances and obstacles beyond the reasonable control of the online store.
The online store reserves the right to refuse to sell goods and demand their return from the Buyer if the price indicated in the online store is significantly lower than its market price due to an error.
6. Consumer Rights for Non-Conforming Goods
The online store is responsible for non-compliance or defects of the goods sold to the Buyer that appear within 6 months from the day of delivery of the goods to the customer or were present at the time of delivery, if such presumption does not contradict the nature of the item or defect. The Buyer must inform the Seller about the non-conformity of the goods as soon as possible, within 2 months after its detection, i.e., submit a complaint. The Buyer can submit a complaint by contacting the online store, writing to davis@matrixsoftlabs.com.
The online store is not responsible for defects that have occurred after the delivery of goods to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request the rectification of the defects or exchange for new goods free of charge.
If it is not possible to repair or replace the goods, the Seller shall return to the Buyer all payments provided for in the Distance contract. The Seller provides a written response to the consumer's complaint within 15 days.
7. Processing of Buyer's Personal Data
The online store processes only those personal data that the buyer has entered when ordering goods, such as name, surname, email, etc.
The online store transfers personal data to the transport service provider(s) to ensure the delivery of goods.
If you have unequivocally agreed to receive our marketing communications, including news, we may occasionally contact you by sending information about our services and latest offers. For this purpose, we may process your email address, which you provided when signing up for marketing communication. The Buyer has the opportunity to opt out of marketing communications by informing us, writing to davis@matrixsoftlabs.com.
8. Dispute Resolution
In matters not covered by these terms and conditions, the Buyer and Seller undertake to comply with the laws in force in the Republic of Latvia.
The parties resolve all disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If it is not possible to resolve the dispute through negotiation or correspondence, the Parties will resolve the dispute in the courts of the Republic of Latvia, in accordance with the laws of the LR. Disputes between the Buyer (consumer) and the Seller can be submitted to the Consumer Rights Protection Center or the courts of the Republic of Latvia.
The Buyer also has the right to address the dispute resolution bodies of the European Union.
